Condo Repair Radar: Terms of Service

Last updated: [DATE]

These Terms are a contract between Until Sunrise LLC, a Florida limited liability company doing business as Condo Repair Radar ("we," "us"), and the company that signs up ("you," "Subscriber"). By creating an account, paying, or using the service, you agree to these Terms. If you are signing up for a company, you confirm you have authority to bind it.

1. What the service is

Condo Repair Radar is a business-to-business subscription data product. It ranks condominium buildings in South Florida by public-record signals (building age, milestone inspection and SIRS status, recertification status, violations, permits, and similar items) that may suggest upcoming repair work. It also lists the association and management company business contact details found in public records.

It is a research tool. It is not a referral service, a bid service, a broker, or a promise of work. We do not represent any association, and we are not acting as a contractor, engineer, or inspector.

2. The data is "as is"

3. Your license

4. Acceptable use (the rules)

You agree not to use the service to:

  1. Offer kickbacks, gifts, or inducements to association board members, officers, or community association managers. This includes cash, gifts, trips, meals, loans, referral fees, or anything of value meant to influence a contract decision. Florida condominium law and manager-licensing rules restrict this conduct (for example, Fla. Stat. § 718.111(1) and § 468.4334 — lawyer to confirm current citations), and it is unethical. Violating this rule is grounds for immediate termination without refund.
  2. Harass anyone. No repeated unwanted contact, threats, showing up at residents' homes, or contacting individual unit owners or board members at personal numbers or addresses.
  3. Send cold text messages or make robocalls / autodialed or prerecorded calls to anyone found through the service. Telephone outreach must comply with the federal TCPA and the Florida Telephone Solicitation Act (Fla. Stat. § 501.059), including prior express written consent where required, the Do-Not-Call lists, and opt-out requests.
  4. Send email that breaks CAN-SPAM. Commercial email must use honest headers and subject lines, identify itself as an ad where required, include your valid physical postal address and a working unsubscribe, and honor opt-outs within 10 business days.
  5. Misrepresent who you are, imply you are affiliated with or endorsed by us, any association, or any government agency, or use the data to scare owners with false claims about building safety.
  6. Break any other law, including licensing, consumer protection, privacy, and anti-discrimination laws.

You are solely responsible for your outreach and for complying with the law. We may suspend or end your account if we reasonably believe you broke these rules.

5. Billing

6. Founding rate

7. Your account

Keep your login codes private. You are responsible for activity under your account. Tell us right away at [support email] if you think your account was misused.

8. Our content and your feedback

We own the service, software, scoring methods, compilation, and design. Public records themselves are not owned by us, but our selection, arrangement, and scoring are. If you send us suggestions, we may use them without owing you anything.

9. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW:

10. Indemnity

You will defend and pay for claims against us (and our members, managers, and contractors) arising from your outreach, your use of the data, or your breach of these Terms or the law, including claims under CAN-SPAM, the TCPA, or the Florida Telephone Solicitation Act.

11. Ending the agreement

You can cancel anytime (see Section 5). We can suspend or end your access for breach of these Terms, non-payment, or if we stop offering the service (in that last case, we will refund any prepaid unused month). Sections 2, 3 (no-resale and deletion), 4, 8, 9, 10, 12 and 13 survive.

12. Florida law and venue

These Terms are governed by Florida law, without regard to conflict-of-law rules. Any lawsuit must be brought in the state or federal courts located in Broward County, Florida, and both parties consent to those courts. [Lawyer: consider adding a jury-trial waiver, a claim filing deadline, and/or arbitration.]
